1. Application
memomarked is operated by Modern Blue Ocean L.L.C., Muscat, Sultanate of Oman (“we”, “us”). These Terms apply to retail and corporate orders for our products and custom manufacturing services. By ordering after these Terms are made available, you accept them and confirm your legal capacity and authority to contract.
2. Orders and Payment
Automated acknowledgements are not acceptance; orders are accepted when we expressly confirm acceptance. We may decline orders for material shortages, technical limitations, suspected fraud or prohibited content, refunding payments for unaccepted orders. Accepted orders may be suspended or cancelled on lawful grounds, with notice and settlement of sums legally due.
Prices are in OMR unless stated otherwise. Applicable taxes, delivery charges and lawful payment stages are disclosed before ordering. Corporate quotations remain valid for 30 days unless specified otherwise. Production requires the agreed payment then due, usable files and any required approval. Customer purchase-order terms apply only if we expressly accept them.
3. Specifications and Approval
You must verify submitted text, spelling, dimensions, artwork quality and specifications. Where proofs are included, production requires your express written or digital approval; otherwise, submitted specifications govern. Proofreading and file correction are excluded unless agreed. Correct reproduction of customer-supplied or approved errors is not a production defect; requested remakes are chargeable. Delayed files or approvals extend the production schedule accordingly.
4. Product Characteristics
Screen colours may differ slightly from finished products. Natural grain, texture and shade differences, minor batch variations, laser-darkened edges and 3D-print layer lines are acceptable where consistent with the disclosed product description and agreed quality. Positional tolerances apply only as disclosed for the particular product before ordering and must not impair its agreed use.
5. Customer Content and Intellectual Property
You warrant that supplied content is lawful and that you hold all necessary rights and permissions. You authorise its use solely to fulfil your order. We may reject infringing, offensive or unlawful content. To the extent legally recoverable, you must indemnify us, our officers and employees for reasonable, documented losses and legal costs from third-party claims caused by your breach of this warranty, excluding our own wrongdoing.
Our original designs, templates and production files remain ours or our licensors’; purchasing a product does not transfer these rights or editable files unless agreed in writing.
6. Changes and Cancellation
Email correction, change or cancellation requests promptly, before dispatch or service delivery. Changes may require revised prices and timelines, subject to agreement. Once custom work begins, discretionary cancellation is subject to our written agreement; any deduction must reflect documented, legally recoverable costs within applicable limits. Mandatory cancellation and refund rights remain applicable. Correctly produced custom goods are not eligible for discretionary change-of-mind returns. Any additional return offer for standard goods will be stated before purchase.
7. Production and Delivery
Production and transit estimates depend on order requirements and destination. An event date requested by you becomes a commitment only if accepted by us; dates expressly promised in the listing, checkout or quotation remain applicable. Events beyond reasonable control may affect estimates, subject to applicable law. You must provide accurate delivery details and arrange receipt. Disclosed, reasonable redelivery charges attributable to your error or unavailability may apply.
8. Inspection and Claims
Inspect goods promptly and email delivery, defect or order issues with your order number, details and supporting photographs where available. Retain affected goods and packaging where reasonably practicable for assessment. We may request reasonable evidence or inspection before determining the claim. Repair, replacement or refund will follow applicable law; this procedure does not shorten statutory claim periods. Damage caused by misuse, unsuitable storage or unauthorised alteration is excluded to the extent attributable to that cause.
9. General Provisions
Omani law governs these Terms; disputes fall within the jurisdiction of the competent Omani courts. Invalid provisions do not affect the remainder. Updates apply to future orders. Personal-data handling is described in our Privacy Policy.
